PVC User Agreement

1. Acceptance of Terms
By accessing and using the PVC E-learning Portal (PeP), you ("User" or "Apprentice") agree to be bound by these Terms and Conditions ("Terms"), all applicable laws and regulations, and agree that you are responsible for compliance with any applicable local laws. If you do not agree with any of these Terms, you are prohibited from using or accessing this platform.
PeP is the dedicated E-learning platform for Pacific Vocational College, which offers vocational training for Plumbing, Gasfitting, Sprinkler Fitting, IP Upgrading, and Cross Connection Control courses.
2. User Obligations and Conduct
As a condition of your use of PeP, you agree to:
a. Enrollment and Identity: Use your true and accurate name and student identification when registering and accessing courses. b. Account Security: Maintain the confidentiality of your account password and notify PVC immediately of any unauthorized use of your account. You are solely responsible for all activities that occur under your account. c. Appropriate Use: Use the platform solely for educational purposes related to the courses you are enrolled in. d. Prohibited Conduct: You must not engage in any activity that is harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable, including but not limited to: * Sharing your login credentials with any other person. * Attempting to gain unauthorized access to any part of the platform or other user accounts. * Uploading or transmitting any virus, malware, or other malicious code. * Posting or transmitting material that is confidential, proprietary, or infringes on the intellectual property rights of others.
3. Course Access, Completion, and Certification
a. Access Duration: Access to course materials is granted for the duration of the scheduled course period. PVC reserves the right to terminate access to the course content after the official completion date of the class. b. Course Completion: Successful completion of all required online modules, assignments, and exams is necessary to receive credit for the online component of the course. c. Practical Components: Accessing PeP does not negate the mandatory requirement to physically attend PVC facilities for practical components. Failure to attend mandatory practicals will result in an "Incomplete" status for the level of training. d. Exam Integrity: You agree to abide by all rules regarding online exam integrity, including the mandatory use of a webcam, remaining actively logged into the virtual classroom, and the potential review of web history.
4. Intellectual Property Rights
a. Ownership: All content on PeP, including but not limited to text, graphics, logos, images, course materials, videos, and software, is the property of PVC Trades School or its licensors and is protected by copyright and other intellectual property laws. b. License to Use: PVC grants you a limited, non-transferable, non-exclusive license to access and use the course content solely for your personal, non-commercial, educational use in connection with your apprenticeship training. c. Restrictions: You are strictly prohibited from copying, reproducing, distributing, modifying, reverse-engineering, publishing, or creating derivative works from any course content without the prior written consent of PVC. Sharing or selling course materials is a violation of these Terms and may result in disciplinary action and/or legal prosecution.
5. Disclaimer of Warranties
The PeP platform and all included content are provided on an "as is" and "as available" basis, without any warranties of any kind, either express or implied, including, but not limited to, the implied warranties of merchantability, fitness for a particular purpose, or non-infringement. PVC does not warrant that the platform will be uninterrupted, error-free, or secure.
6. Limitation of Liability
In no event shall PVC, its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the platform; (ii) any content obtained from the platform; and (iii) unauthorized access, use or alteration of your transmissions or content.
7. Governing Law and Jurisdiction
These Terms shall be governed and construed in accordance with the laws the Province of British Columbia, Canada, without regard to its conflict of law provisions. Any dispute arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Burnaby, British Columbia.
8. Termination
PVC may terminate or suspend your access to PeP immediately, without prior notice or liability, if you breach the Terms or violate any other agreement with PVC, including any course-specific policies (e.g., exam rules). Upon termination, your right to use the platform will immediately cease.
9. Changes to Terms
PVC reserves the right to modify or replace these Terms at any time. We will provide notice of any material changes by posting the new Terms on the PeP platform. Your continued use of the platform after any such changes constitutes your acceptance of the new Terms.

By clicking the "I Agree" button or by logging into and using the PVC E-learning Portal (PeP), you acknowledge that you have read, understand, and agree to be bound by the above Terms and Conditions of Use.
